Acceptance of These Terms

These Terms of Use ("Terms") are a binding agreement between you and Funded Prediction Trader ("FPT", "we", "us" or "our"). They govern your visit to fundedpredictiontrader.com, your use of any FPT website, application, dashboard, account or support channel, and your use of any content or tool FPT makes available (together, the "Platform").

"You" means the individual reading and using the Platform. If you use the Platform on behalf of another person or an organisation, you confirm that you are authorised to bind that person or organisation, and "you" then means both you and them.

You accept these Terms electronically. You do this by creating an FPT account, by ticking an acceptance box at registration or checkout, by making a purchase, or simply by continuing to use the Platform. Electronic acceptance has the same force as a handwritten signature. Continued use after these Terms are updated is acceptance of the updated version.

If you do not accept these Terms, do not use the Platform.

FPT is a software-based simulated trader evaluation company. Account balances, orders, positions, fills and profits inside an FPT account are simulated. FPT is not a brokerage, exchange, custodian, investment adviser, portfolio manager, bank, financial institution or trading venue, and FPT does not hold customer funds or route customer orders to any market. Read the Simulation and Risk Disclosure before you purchase anything.


To create an FPT account or purchase anything from FPT, you must be at least 18 years old, or older if the age of majority where you live is higher, and you must have the legal capacity to enter into a binding contract. An FPT account may not be created by, held by, or used on behalf of a minor.

You are responsible for determining whether your use of the Platform is permitted under the laws that apply to you. Laws differ by country, state and province, and they change. FPT does not give you legal advice about your own jurisdiction, and nothing on the Platform should be read as a statement that FPT's products are lawful or suitable for you where you are.

FPT may decline, restrict or close an account where FPT reasonably believes that providing the Platform to you is prohibited, restricted or impractical under applicable law, sanctions rules, or a service provider's requirements. FPT may also require identity verification before activating an account, releasing a payout, or continuing to provide the Platform. Verification requirements are described in the Help Center and in the FPT Scale Program Agreement.

FPT does not publish a list of restricted locations in these Terms. Where a restriction applies to you, FPT will tell you at the point it applies.


Account Registration and Security

You must provide accurate, current and complete information when you register, and keep it accurate. An account registered with false, borrowed or misappropriated information may be suspended or closed, and a payout tied to it may be withheld pending review.

You are responsible for safeguarding your login credentials, any multi-factor authentication method attached to your account, and the email address the account is registered to. You are responsible for all activity that occurs under your account, whether or not you authorised it, except to the extent the activity results from FPT's own failure.

You must not share your credentials, let another person use your account, or use another person's account. Account sharing, credential sharing and trading on someone else's behalf are breaches of the program and are treated under Good-Faith Trading and Prohibited Conduct.

Tell FPT immediately at support@fundedpredictiontrader.com if you know or suspect that your credentials have been lost, disclosed or used without your permission. FPT may suspend access while it investigates a suspected compromise. Suspension in that situation protects the account and is not a penalty.


One Profile Per Person

Each person may hold one FPT profile. That single profile is where every account, purchase, rule version and payout record lives.

Duplicate profiles, profiles created under a second email address, a relative's name, an alias or a company name in order to obtain additional accounts, additional evaluations, additional promotional pricing or additional payout capacity are prohibited. So is coordinated trading across related profiles designed to produce a payout from opposite positions.

Where FPT reasonably determines that two or more profiles belong to the same person, or are operated by the same person or group, FPT may merge them, close the duplicates, cancel affected evaluations, void simulated results produced through the duplication, withhold or reverse an affected payout, and decline a discretionary refund. FPT will tell you what it found and give you a route to respond, as described in the Program Agreement.

Per-person limits apply across every account you hold, in evaluation and funded, and cannot be reset by opening a second profile.

Whether the monthly payout maximum is measured on a calendar month or a rolling period is not yet settled. FPT will publish the exact measurement period before launch, in Account Limits and Allocation Caps. FPT will not apply a stricter reading of that limit than the version published at the time it applies to you.


Licence to Use the Website and Platform

Subject to these Terms, FPT grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable, personal licence to access and use the Platform for your own individual use — evaluating FPT's products, taking part in a program you have purchased, and reading FPT's published material.

This licence does not transfer ownership of anything. It ends automatically if these Terms end, if your account is closed, or if FPT withdraws it under these Terms.

You may not resell, rent, sublicense, redistribute, or commercially exploit the Platform or its content, and you may not use it to build, train or operate a competing product or service. You may not remove or obscure any proprietary notice.


Acceptable Use

You agree to use the Platform lawfully, honestly, and in the way a reasonable person would understand it is meant to be used. Specifically, you agree that you will not:

  • Provide false information to FPT, or impersonate another person, company or FPT itself.
  • Use the Platform for money laundering, sanctions evasion, fraud, or any other unlawful purpose.
  • Attempt to obtain a payout by any means other than trading a simulated account under the published rules.
  • Coordinate trading with another person or another account in order to manufacture a result rather than earn one.
  • Exploit a simulation fault, a pricing error, a stale or erroneous data feed, a latency artefact, or any other technical defect, whether or not FPT caused it.
  • Harass, threaten, defame or abuse FPT staff, another customer, or a member of an FPT community channel.
  • Post, upload or transmit content that is unlawful, infringing, malicious, or that you have no right to share.
  • Misrepresent FPT's products publicly, including presenting simulated results as live trading results.
  • Use the Platform in a way that damages FPT's reputation, security or ability to serve other customers.

Program conduct rules sit alongside this section and apply to trading activity in an FPT account. They are published in Good-Faith Trading and Prohibited Conduct and incorporated into the Program Agreement.


Prohibited Technical Abuse

The following are prohibited without FPT's prior written permission, and each is independently a material breach of these Terms:

  • Scraping, crawling, harvesting or systematically copying any part of the Platform or its data, by any automated or manual method.
  • Running bots, scripts, headless browsers or automation against the Platform, including automated account creation, automated checkout, automated order entry, or automated data extraction, other than through an interface FPT has expressly published for that purpose.
  • Reverse engineering, decompiling, disassembling or otherwise attempting to derive source code, model logic, risk logic or simulation logic from the Platform.
  • Load testing, stress testing, penetration testing, vulnerability scanning or any similar security testing of FPT systems.
  • Circumventing or attempting to circumvent a rate limit, position limit, access control, authentication step, geographic control, entitlement check or paywall.
  • Introducing malware, or interfering with the Platform's operation, integrity or availability for other users.
  • Accessing another user's account, data or session, or attempting to.

FPT may block, throttle or ban traffic that it reasonably believes falls into this section, without notice, and may pursue the remedies in the Suspension and Termination section as well as any legal remedy available.

If you believe you have found a security vulnerability, do not test it further. Report it to support@fundedpredictiontrader.com with enough detail to reproduce it, and give FPT a reasonable opportunity to fix it before disclosing it anywhere.


Intellectual Property

The Platform and everything in it — the software, the simulation and risk engine, the dashboard, the analytics, the rule set as expressed in FPT's documents, the written content, the articles, the graphics, the figures, the layouts, the design system, the "FPT" and "Funded Prediction Trader" names and marks — are owned by FPT or licensed to FPT, and are protected by intellectual property law.

Nothing in these Terms transfers any of that to you. Any right not expressly granted is reserved.

You may quote short passages of FPT's published articles with clear attribution and a link to the original. You may not republish an article in full, republish FPT's rules as if they were your own, or use FPT's marks in a way that suggests endorsement, affiliation or partnership that does not exist.

Third-party names and marks that appear on the Platform belong to their respective owners and are used for identification only.


FPT's simulated accounts reference selected Polymarket + Kalshi markets. Polymarket, Kalshi and TruthTick are independent third parties. FPT is not affiliated with, sponsored by, endorsed by, or acting as an agent for any of them unless FPT states so expressly in writing. Their trademarks belong to them.

FPT does not give you an account with, access to, or a relationship with any third-party venue. FPT does not route your orders anywhere, does not hold funds for you, and does not execute live trades for you. If you separately choose to use a third-party platform, that is a relationship between you and that platform, on their terms, and FPT is not responsible for it.

Market data displayed on the Platform is provided for the operation of a simulated product. It may be delayed, incomplete, interrupted, revised or wrong. Simulated fills consider live market price and available liquidity; estimated slippage and price impact are estimates and are not guaranteed. FPT does not promise that a simulated fill matches what would have happened in a live market.

Position limits reference third-party market activity. A position may not exceed 5% of that market's trailing 24-hour volume, and the allowed position size is the lower of that figure and your account's max open size.

Thin or unavailable markets may be restricted, and orders that exceed a limit are blocked by the trading system. Full detail is in Max Open Size and Market-Volume Limits and Market Expiration and Late-Entry Restrictions.

The Platform may link to third-party websites. FPT does not control them, does not endorse them by linking to them, and is not responsible for their content, their terms or their privacy practices. Read their terms before you rely on them.


User Content and Communications

FPT may operate community channels, comment surfaces, support conversations and feedback forms. Anything you post or send through them is "User Content".

You keep ownership of your User Content. You are responsible for it, and you confirm you have the rights needed to share it. Do not post confidential information, another person's personal information, credentials, or anything you are not free to share.

By posting User Content on an FPT surface, you grant FPT a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display and distribute it for the purpose of operating and moderating that surface.

Feedback is treated differently. If you send FPT a suggestion, feature idea, bug report or other feedback, you grant FPT a perpetual, irrevocable, worldwide, royalty-free licence to use it for any purpose without restriction, attribution or compensation. FPT is free to develop something similar independently, and nothing in your feedback creates a confidential relationship.

FPT may remove User Content, moderate a channel, and remove access to a community surface at its discretion, including where content breaches the Acceptable Use section. FPT does not undertake to review everything posted, and content posted by other users is theirs, not FPT's.


You consent to receive communications from FPT electronically — by email to the address on your account, by notice in the dashboard, and by notice posted on the Platform. Electronic communications satisfy any legal requirement that a communication be in writing.

You consent to sign and accept agreements, disclosures, rule versions and consent records electronically. A record of your acceptance — including which document versions and which rule versions were in force at the time — is stored against your purchase.

You need a device with a current browser, an internet connection, a working email address, and the ability to view and save documents in a standard format. Keep your email address current; a notice sent to the address on your account is treated as received.

You may withdraw consent to electronic communications by writing to support@fundedpredictiontrader.com, but FPT's products are delivered electronically, so withdrawing consent generally means closing your account. FPT will always send transactional and legally required notices, regardless of marketing preferences.


Availability, Maintenance and Modifications

FPT does not guarantee uptime. The Platform may be unavailable or degraded because of maintenance, deployments, capacity, a third-party data or infrastructure failure, a network issue, or an event outside FPT's reasonable control.

FPT may change, add, suspend or remove features of the Platform. FPT may run scheduled and unscheduled maintenance, and will give advance notice of planned maintenance where it reasonably can.

Where a change affects the commercial or rule terms you purchased, the versioning and notice rules in the Program Agreement and the Current FPT Scale Rules Index govern, not this section. Material purchased terms are not silently changed retroactively.

Before FPT Scale accounts become tradeable, parts of the dashboard are clearly marked "Coming soon". That is expected, and it is described in the Program Agreement and in Founder Purchase and Launch Terms.


Disclaimers

The Platform is provided "as is" and "as available", without warranty of any kind. To the fullest extent permitted by law, FPT disclaims all warranties, express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and any warranty arising from a course of dealing or usage of trade.

FPT does not warrant that the Platform will be uninterrupted, secure, error-free, or free of harmful components, that market data will be accurate or continuous, that a simulated fill will reflect a live market, or that any result — passing an evaluation, reaching a payout, or reaching any scaling milestone — will be achieved.

Expressly, and without limiting the above:

  • FPT is not a broker, dealer, exchange, custodian, investment adviser, portfolio manager, bank, financial institution or trading venue, and is not registered as any of those.
  • FPT does not hold customer funds, take deposits, or execute live trades for customers.
  • FPT does not provide financial, investment, legal, tax or accounting advice. Nothing on the Platform is a recommendation to enter any transaction or a statement that any strategy is suitable for you.
  • FPT's educational and analytical content is general information, not personalised advice. Consult your own qualified adviser before making a financial or legal decision.
  • Simulated performance is not live performance, and past results — simulated or otherwise — do not indicate future results.

Program fees are paid for access to an evaluation program. They are not an investment, a deposit, a subscription to a managed account, or the purchase of a financial instrument.


Technical Incidents

Software fails sometimes. Data feeds break, prices arrive wrong, an engine miscalculates, a deployment misbehaves, a dashboard shows a figure that never should have existed.

Where FPT reasonably determines that account activity was affected by a technical incident — including a market-data error, a feed outage, a pricing error, an execution or simulation fault, a display error, or a defect that produced a result the rules would not have produced — FPT may, at its discretion and acting in good faith:

  • Correct the affected balance, position, order record or statistic.
  • Void or re-run the affected simulated activity.
  • Adjust or restore an account's state to what it would reasonably have been without the incident.
  • Pause an evaluation, a payout cycle or a payout review while it investigates.
  • Decline to treat a result produced by the defect as a valid result, whether that result favoured you or FPT.

FPT will apply this section consistently. A profit produced only by a defect is not owed to you, and a loss produced only by a defect will not be held against you.

FPT does not guarantee compensation for a technical incident, and does not compensate for a hypothetical profit that a working system might have produced. Where a defect deprived you of program time, FPT may extend a deadline or restore a cycle stage rather than pay anything. Anything more is discretionary. If you believe an incident affected your account, contact support@fundedpredictiontrader.com promptly with the account, the market, the time and what you observed.


Limitation of Liability

To the fullest extent permitted by law, FPT and its owners, officers, employees, contractors and service providers will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost revenue, lost opportunity, lost or hypothetical trading gains, loss of goodwill, business interruption, or loss or corruption of data, arising out of or relating to the Platform or these Terms, whether based in contract, tort, strict liability, statute or any other theory, and whether or not FPT was advised that such damages were possible.

To the fullest extent permitted by law, FPT's total aggregate liability for all claims arising out of or relating to the Platform or these Terms is limited to the total amount you actually paid to FPT in the 12 months immediately before the event giving rise to the claim. If you paid FPT nothing in that period, FPT's total aggregate liability is limited to the amount permitted by law and, where the law permits, to zero.

These limits apply even if a limited remedy is found to have failed its essential purpose, and they are a fundamental part of the basis on which FPT offers the Platform at the prices it does.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or limited. Where a jurisdiction does not permit part of this section, that part applies to the maximum extent that jurisdiction allows, and the rest of this section stays in force.


Indemnification

You agree to indemnify, defend and hold harmless FPT and its owners, officers, employees, contractors and service providers from and against any claim, demand, proceeding, loss, liability, damage, fine, cost or expense, including reasonable legal fees, arising out of or relating to:

  • Your breach of these Terms, the Program Agreement, or any incorporated rules article.
  • Your misuse of the Platform, including anything in the Prohibited Technical Abuse section.
  • Your User Content, or your public statements about FPT.
  • Your violation of any law, or of any third party's rights, including intellectual property and privacy rights.
  • Any tax obligation arising from a payout made to you.
  • Any activity under your account, including activity by a person you allowed to use it.

FPT may assume the exclusive defence and control of any matter subject to indemnification by you, at your expense, and you agree to cooperate with that defence. You will not settle any matter that imposes an obligation on FPT without FPT's prior written consent.


Suspension and Termination

You may stop using the Platform at any time, and you may ask FPT to close your account by writing to support@fundedpredictiontrader.com. Closing an account does not by itself entitle you to a refund; refunds are governed by the Refund, Cancellation and Chargeback Policy.

FPT may suspend or restrict your access, and may close your account, where FPT reasonably believes that:

  • You have breached these Terms, the Program Agreement, or an incorporated rules article.
  • Your account is being used fraudulently, unlawfully, or by someone other than you.
  • Verification information you provided is false, or required verification was not completed.
  • Continuing to serve you would breach a law, a sanctions rule, or a service provider's requirement.
  • Continued access presents a security, integrity or fraud risk to FPT or its customers.

FPT will give notice where it reasonably can, and will act immediately without notice where the risk requires it. Where a suspension follows a suspected breach, the review and response process in the Program Agreement applies, and FPT may withhold a pending payout until the review is complete.

Termination ends your licence to use the Platform. The following survive: the Intellectual Property, User Content and Communications, Disclaimers, Technical Incidents, Limitation of Liability, Indemnification, Governing Law, Dispute Resolution and Contact sections, along with any obligation to pay an amount already due.


Governing Law

These Terms, and any dispute arising out of or relating to them or to the Platform, are governed by the laws of the State of Nevada, United States, without regard to its conflict-of-laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Where you live somewhere whose mandatory consumer-protection law gives you rights that cannot be excluded by agreement, those rights continue to apply to you, and this section does not remove them.


Dispute Resolution

Read this section carefully. It affects how disputes with FPT are resolved.

Informal resolution first. Before starting arbitration or a court proceeding, you agree to try to resolve the dispute informally. Send a written notice of dispute to legal@fundedpredictiontrader.com describing who you are, the account concerned, what happened, what you want, and how FPT can reach you. FPT will send a notice to the email on your account. Both sides agree to negotiate in good faith for 30 days from the date the notice is sent. This informal step is a precondition to arbitration, and the 30-day period pauses any limitation period on that dispute.

Binding individual arbitration. If the dispute is not resolved within 30 days, either side may elect to resolve it by final and binding arbitration rather than in court, before a single arbitrator, under the rules of an established arbitration administrator agreed by the parties or, failing agreement, appointed under applicable law. The arbitrator decides all issues, including the scope and enforceability of this section, except that a court decides whether the class-action waiver below is enforceable. The arbitrator may award any relief a court could award to that individual claimant. The award is final and may be entered as a judgment in any court of competent jurisdiction.

Where and how. Arbitration takes place in Clark County, Nevada, or by video or telephone where the arbitrator permits it. Where the amount in dispute is small enough for the administrator's documents-only procedure, either side may ask for the dispute to be decided on written submissions. Each side bears its own legal fees unless the arbitrator awards otherwise or applicable law requires otherwise.

Class-action waiver. Disputes are resolved individually. You and FPT each waive any right to bring or take part in a class, collective, consolidated, mass or representative action, and the arbitrator may not consolidate more than one person's claims or preside over any form of representative proceeding. If this waiver is found unenforceable for a particular claim, that claim is severed from arbitration and heard in court, and the remaining claims stay in arbitration.

Small-claims carve-out. Either side may bring an individual claim in a small-claims court that has jurisdiction, instead of arbitration, so long as the claim stays in that court and stays individual.

Injunctive carve-out. Either side may seek injunctive or equitable relief in court to stop actual or threatened infringement, misappropriation or misuse of intellectual property, confidential information or Platform security.

Opting out of arbitration. You may opt out of the arbitration agreement and the class-action waiver in this section by sending a written opt-out notice to legal@fundedpredictiontrader.com that states your name, the email on your FPT account, and that you are opting out. Opting out does not affect any other part of these Terms, and FPT will not treat an opt-out as grounds for closing your account or refusing service. The exact length of the opt-out window has not been fixed; FPT will publish it in this section before FPT Scale accounts become tradeable, and until it is published FPT will treat an opt-out notice as timely. If you opt out, or if this arbitration agreement does not apply to a dispute, that dispute is resolved in the state and federal courts located in Clark County, Nevada, and you and FPT each consent to the personal jurisdiction of those courts and waive any objection to that venue.

Not legal advice. This section is a conventional dispute-resolution framework drafted for FPT's own use. It is not legal advice to you, no lawyer has represented you in agreeing to it, and you are free to take your own advice before accepting these Terms.


Changes to These Terms

FPT may update these Terms. Every version carries a version number, an effective date and a last-updated date, shown at the top of this page.

For a material change — one that meaningfully changes your rights, your obligations, or the way disputes are handled — FPT will give notice by email to the address on your account, by notice in the dashboard, or both, before the change takes effect. For a non-material change, such as a clarification, a corrected reference or a formatting fix, FPT updates the page and the last-updated date.

Continued use of the Platform after a change takes effect is acceptance of the changed version. If you do not accept a change, stop using the Platform and ask FPT to close your account.

A change to these Terms does not by itself change the commercial or rule terms of a purchase you have already made. Those are governed by the version records described in the Program Agreement and the Current FPT Scale Rules Index. A material change to an incorporated rule states whether it applies only to new purchases or also to existing accounts. Material purchased terms are never silently changed retroactively.


Relationship With the FPT Scale Program Agreement

These Terms govern general use of the FPT website, platform and account. The FPT Scale Program Agreement governs the FPT Scale program itself — what you bought, how the simulated evaluation and funded stages work, fees, payouts, scaling, breaches and termination of the program relationship.

For any FPT Scale program matter, the Program Agreement controls and these Terms fill the gaps. For general website and platform use, these Terms control.

An unversioned support answer never changes your purchased terms. If a support reply and a versioned document disagree, the versioned document governs, and FPT would like to know about the discrepancy.


General Terms

Entire agreement. These Terms, together with the documents listed in the precedence table, are the entire agreement between you and FPT on their subject matter, and replace any earlier understanding on that subject.

Severability. If a provision is found unenforceable, it is limited or severed to the minimum extent necessary and the rest of these Terms stay in force.

No waiver. FPT's failure to enforce a provision is not a waiver of it, and a waiver given once is not a waiver of any later breach.

Assignment. You may not assign or transfer these Terms or your account without FPT's prior written consent. FPT may assign these Terms to a successor in connection with a merger, acquisition, reorganisation or sale of assets.

No third-party beneficiaries. Except for the FPT parties named in the Disclaimers, Limitation of Liability and Indemnification sections, these Terms create no rights for anyone who is not a party to them.

Force majeure. Neither side is liable for a failure or delay caused by an event outside its reasonable control, including a network or infrastructure failure, a third-party service failure, a natural event, or a governmental action.

Headings. Headings are for navigation only and do not affect interpretation.
